Is crypto mining legal?
Crypto mining is legal in the US and many other countries, but China bans it and several governments restrict it over energy use and grid strain.
Is crypto mining legal? In most of the world's big mining hubs, yes, including the United States. The main exceptions are countries that ban crypto outright or that have turned against mining because it uses so much electricity. Is bitcoin mining legal in the US?
Yes. There is no federal ban, and the US has become the largest mining market, ahead of Kazakhstan and Russia, according to reporting on a 2021 Library of Congress study. Federal attention has focused on energy rather than legality. In February 2024, the US Energy Information Administration estimated that crypto mining used about 0.6% to 2.3% of US electricity and began surveying miners for better data.

What are the crypto mining laws by state?
States vary a lot. New York passed a two-year moratorium, signed on November 22, 2022, that stopped new or renewed permits for fossil-fuel power plants used for proof-of-work mining. Mines already holding permits were not affected, and renewable-powered mining was outside the law.
Arkansas went the other way in 2023 with the Arkansas Data Centers Act, which limited how much local governments could regulate crypto mines. After complaints about noise, lawmakers passed bills in 2024 to set noise limits, let local governments regulate mines, and bar ownership by businesses controlled by certain foreign countries. Is crypto mining legal in China?
No. In September 2021, China's National Development and Reform Commission and the People's Bank of China led a notice banning new mining projects and ordering existing ones to exit. Mining was classed as an industry to be eliminated, and power companies were told not to supply mines. China had previously hosted about two-thirds of the industry.
Which countries ban or restrict crypto mining?
Countries that ban crypto entirely effectively ban mining too. A 2021 Library of Congress report found absolute crypto bans in nine places, including China, Algeria, Bangladesh, Egypt, Iraq, Morocco, Nepal, Qatar and Tunisia. See is cryptocurrency legal for the wider picture.
Others restrict mining where power is scarce. Russia legalized mining in 2024 but banned it in 10 regions from January 1, 2025 until March 15, 2031, with seasonal limits in parts of Siberia. In May 2025, Kuwaiti authorities raided homes running mining rigs and called mining an unlawful use of electricity.
