The SEC crypto task force is a working group inside the US Securities and Exchange Commission that aims to clarify how securities law applies to crypto. It was launched in January 2025, when the agency shifted away from setting crypto policy mainly through lawsuits, a change described in what the SEC does in crypto.

What does the SEC crypto task force do?

Its stated mission is to help the SEC draw clear lines on crypto and recommend practical policy that encourages innovation while protecting investors. When it was announced, the SEC said its goals were to:

  • set out who needs to register and offer realistic paths to registration
  • design disclosure rules suited to crypto
  • use enforcement resources judiciously
  • work with the CFTC, state regulators and international bodies, within the laws Congress has passed

A central question is which tokens are securities and which are not, the test explained in is crypto a security.

Who leads the SEC crypto task force after Hester Peirce?

Acting Chairman Mark Uyeda created the task force and put Commissioner Hester Peirce in charge, with Richard Gabbert as chief of staff and Taylor Asher as chief policy adviser. Peirce had long argued for clearer crypto rules. She resigned from the SEC effective October 2, 2026, and was reported to be moving to academia. As of mid-October 2026, the SEC's task force page does not name a new leader.

How does the task force gather input?

The task force holds public roundtables on specific subjects. One in June 2025 covered decentralized finance, where Chairman Paul Atkins discussed self-custody, staking and whether developers of non-custodial software should face securities liability. It also accepts written input by email at [email protected], holds meetings with industry and experts, publishes FAQs and statements, and hosts educational sessions for SEC staff.

What SEC crypto rules and guidance has it shaped?

Press coverage of Peirce's exit credited the group with interpretations, guidance and no-action letters, the staff letters saying the SEC will not recommend action against a specified activity. The SEC's wider crypto agenda since 2025 includes:

  • March 17, 2026. A Commission interpretation, joined by the CFTC, sorting crypto assets into five categories: digital commodities, digital collectibles, digital tools, stablecoins and digital securities.
  • September 17, 2026. An order granting temporary, conditional relief, called the innovation exemption, so approved venues can trade tokenized stocks onchain in a permissioned setting.
  • Open proposals. As of October 2026 the task force page lists open comment requests on custody rules, Regulation Crypto Assets, transfer agent rules and registered offering reform.

Exemptions and interpretations issued by the agency are not the same as laws passed by Congress. The guide to the CLARITY Act covers the attempt to set these lines in statute.

Rules differ by country and change often. Check the official regulator or a qualified professional for your own situation.
