What happens if you don't report crypto on your taxes?
If you don't report crypto, the IRS can charge the unpaid tax plus interest and penalties of 20% or more. An amended return can fix a missed report.
If you don't report crypto on your taxes in the US, the main risk is a bill for the missing tax plus interest and penalties. The IRS can see much crypto activity, since brokers now report sales on Form 1099-DA. The IRS treats crypto as property, and it says every sale, swap or disposal must be reported whether or not it produced a taxable gain. How it finds unreported crypto, through letters, summonses and broker forms, is covered in does the IRS audit crypto. This guide covers the consequences and the fix.
What happens if you don't report crypto gains?
The gain is still taxable, so the IRS can assess the tax you should have paid, plus interest. Penalties come on top.
- Accuracy-related penalty. This is 20% of the underpayment. It applies to the whole underpayment when the understatement is a "substantial understatement", which for individuals means more than the greater of 10% of the correct tax or $5,000. It can also apply to the part caused by negligence, and the IRS gives leaving off income reported on a Form 1099 as an example.
- Civil fraud penalty. If the underpayment is due to fraud, the penalty rises to 75% of the portion attributable to fraud.
- Interest. The IRS charges interest on penalties as well as on unpaid tax.
The IRS may reduce or remove some penalties if you acted in good faith and had reasonable cause.
What if you didn't file a tax return at all?
Not filing is treated separately. The failure-to-file penalty is 5% of the unpaid tax for each month or part of a month the return is late, up to 25%. For returns due in 2026 that are more than 60 days late, the minimum is $525 or 100% of the tax owed, whichever is less. A failure-to-pay penalty of 0.5% a month can also run, and it continues after the filing penalty stops growing.
What happens if you don't report crypto losses?
Leaving out a loss usually means you paid more tax than needed, not less. Capital losses offset capital gains, and up to $3,000 of net loss a year ($1,500 if married filing separately) can be deducted against other income, with the rest carried forward. The IRS still expects losses to be reported on Form 8949 with the same records as gains. See crypto losses and taxes for more.
How do you fix a crypto report you missed?
File an amended return on Form 1040-X. The IRS says to amend when you find a mistake in income or tax, and you can e-file it with tax software for recent years. If you owe more, paying promptly limits further interest, and the IRS calculates any interest and penalties itself after a late amendment. To claim a refund from an overlooked loss, the deadline is generally 3 years from filing or 2 years from paying, whichever is later. The forms involved are explained in crypto tax forms.
