Crypto is lightly taxed in El Salvador. As of October 2026, the Bitcoin Law states that exchanges in bitcoin are not subject to capital gains tax, and a separate 2023 law exempts gains and returns on digital assets issued under its rules. Taxes themselves must be paid in US dollars.

Is there a bitcoin capital gains tax in El Salvador?

No, according to the law's text. Article 5 of the Ley Bitcoin (Legislative Decree 57 of 2021) says bitcoin exchanges are not subject to capital gains taxes. Decree 199, approved on January 29, 2025 and published the next day, reformed several articles of the law, including Article 5, and repealed others. The consolidated text on the government's legal database still carries the capital gains exemption, and Bloomberg Tax's summary of Decree 199 lists exempting bitcoin exchanges from capital gains tax among its measures.

The same reform made acceptance of bitcoin voluntary. For how bitcoin's legal status changed, see is bitcoin legal tender in El Salvador.

Can you pay taxes in bitcoin in El Salvador?

Not anymore. The original 2021 law let people pay taxes in bitcoin. The 2025 reform repealed that, and the IMF listed making tax payments only in US dollars as a step El Salvador took before its roughly $1.4 billion program was approved in February 2025. The IMF program also commits the government to limit its own bitcoin activity.

How does the El Salvador Digital Asset Issuance Law treat taxes?

The Ley de Emisión de Activos Digitales, Decree 643, was approved in January 2023 and took effect on February 1, 2023. It created the National Commission of Digital Assets (CNAD), which registers and supervises issuers, certifiers and service providers.

Article 36 sets out the tax treatment. The face value and returns of digital assets covered by the law are exempt from taxes, and so are capital gains and income from selling or transferring them. Registered issuers, certifiers and service providers are exempt from VAT, income tax and municipal taxes on their digital asset activities, and those benefits extend to their shareholders. The exemptions do not apply to exchanges of digital assets for goods or services outside those the law lists.

What still needs checking for El Salvador crypto tax laws?

These exemptions are tied to specific laws. They cover bitcoin exchanges under the Bitcoin Law and assets within the digital assets law, not every type of income a person or company earns in El Salvador. Your home country may also tax you on gains made there, depending on residency. For comparisons, see crypto tax around the world and which countries have no crypto tax.

Rules differ by country and change often. Check the tax authority or a qualified professional for your own situation.
