Crypto is effectively illegal in Kuwait. Rules issued in July 2023 ban using crypto for payments, dealing in it as an investment and mining it, and they bar anyone from being licensed to offer crypto services. As of October 2026 those rules remain the basis of Kuwait's approach.
Is crypto illegal in Kuwait?
Largely, yes. The Capital Markets Authority (CMA) announced the rules on July 18, 2023, in circulars that also came from the Central Bank of Kuwait, the Ministry of Commerce and Industry and the insurance regulator. According to Gulf Business, the circulars treat virtual assets as illegal and set an absolute ban on using them for payments. They followed a study by Kuwait's national anti-money-laundering committee and were framed as a way to meet Financial Action Task Force standards. See crypto anti-money-laundering rules for that background.
The ban does not cover securities and financial instruments that the central bank and the CMA already regulate, Charltons Quantum reported.
Is bitcoin legal in Kuwait?
No. Bitcoin is not recognized as money or as a legal investment. The circulars do not separately describe penalties for an individual who simply holds bitcoin, but buying it as an investment, paying with it and mining it all fall under the ban, and Charltons noted that crypto lacks legal status in Kuwait.
Is crypto trading legal in Kuwait?
No. Dealing in crypto as an investment is forbidden, and businesses may not offer crypto services. No one in Kuwait may be licensed as a virtual asset service provider, and no such license had ever been issued, Gulf Business reported. That means there is no legal route to a local crypto exchange.
Is crypto mining legal in Kuwait?
No. The 2023 circulars banned all crypto mining, and enforcement stepped up in 2025. In April 2025 the Interior Ministry said electricity data pointed to more than 1,000 possible mining sites, called mining an unauthorized activity that breaks the law, and warned it would prosecute, Decrypt reported. A joint check with the electricity ministry flagged about 100 homes in Al-Wafrah using roughly 20 times as much power as their neighbors. After the crackdown, consumption in the area fell 55 percent almost overnight, DatacenterDynamics reported. Other countries' rules are compared in is crypto mining legal.
Kuwait's approach contrasts with nearby Bahrain, which licenses crypto firms. For more, see crypto regulation around the world.
Rules differ by country and change often. Check the regulator or a qualified professional for your own situation.
