Crypto is legal to own in Mexico, but it is not legal tender and the country's regulated financial institutions are not allowed to sell it to the public. People in Mexico can hold bitcoin, while banks and other supervised firms face tight limits set by the central bank, Banco de México (Banxico). As of October 2026, the main public statement on these rules is a joint notice from June 2021.

Is bitcoin legal in Mexico?

Owning bitcoin is not banned. In a June 28, 2021 joint statement, Banxico, the Finance Ministry (SHCP) and the banking and securities regulator (CNBV) said virtual assets are not legal tender in Mexico and are not currencies under the current legal framework. That means no one is required to accept bitcoin as payment, and the Mexican peso remains the national currency.

The statement came as other countries were debating crypto as money. It also restated warnings issued in 2014, 2017 and 2019. Authorities described virtual assets as highly volatile, said they have no intrinsic value, and called their use as a means of payment limited.

Is crypto illegal in Mexico for banks and fintech firms?

This is where the rules bite. The Fintech Law of 2018 allows credit institutions to work with certain virtual assets only if Banxico approves them. Banxico set the details in Circular 4/2019, published in March 2019.

Under those rules, institutions can only carry out internal operations, such as using crypto to support their own services or international transfers, and only with prior Banxico authorization. They must also keep the risk of these operations away from customers. The 2021 statement said financial institutions are not authorized to offer the public crypto deposits, custody, exchange or transfers, naming Bitcoin, Ether and XRP as examples.

The statement also covered stablecoins. Offering stablecoin services that take deposits from the public in pesos or foreign currency without authorization would count as unauthorized deposit-taking.

Crypto apps that are not Mexican banks have still served Mexican users. For example, Coinbase said in 2019 that it was adding crypto-to-crypto trading in Mexico. Profits from crypto can be taxable, as explained in how crypto is taxed in Mexico.

Is crypto mining legal in Mexico?

The official statements on virtual assets focus on financial institutions and public offerings. They do not set specific rules for mining. Anyone mining still has to follow normal business, electricity and tax rules. Our guide to whether crypto mining is legal explains how countries approach it.

Does Mexico have its own cryptocurrency?

No. Under the 2021 statement, virtual assets are not legal tender or currency in Mexico, so the country has no official cryptocurrency. For a country that took a different path, see is bitcoin legal tender in El Salvador. Banxico's own material on virtual assets reviews how countries such as Japan, South Korea and EU members regulate crypto, but Mexico's money is still the peso.
