Do states tax crypto?
Most US states with an income tax tax crypto gains the same way the IRS does. Texas and Florida have no personal income tax, while Washington taxes large gains.
State crypto tax depends mainly on whether your state has a personal income tax. Most states that do start from the federal approach, where crypto is treated as property and gains or losses arise when you sell, swap or spend it. The federal rules are explained in how crypto is taxed in the US. A few states have no income tax at all.
How do states with an income tax treat crypto?
Most follow the IRS. New York's tax department, for example, said in a 2014 memo that because the IRS treats convertible virtual currency as property, general property rules apply to crypto for state income and corporate tax. In practice, the gain you report on your federal return usually flows through to your state return, where it is taxed at state rates.
New York's memo also covered sales tax. Paying for taxable goods with crypto is treated as a barter, and the buyer owes sales tax based on the dollar value of the crypto at the time.
What is the crypto tax in California?
California taxes crypto gains as part of ordinary income. Its Franchise Tax Board says California does not have a lower rate for capital gains, so all gains are taxed as regular income at the state's rates, even when the same gain gets a lower long-term rate federally. Where federal and California treatment differ, taxpayers file California's own Schedule D (540).
Is there crypto tax in Texas and Florida?
Not at the state level for individuals. The Texas Comptroller says Texas has no state income tax, and the Florida Department of Revenue says Florida does not impose a personal income tax, so residents of those states do not file a state income tax return on crypto gains. Federal tax still applies, and the federal crypto tax forms are the same in every state.
Businesses are a different matter. Texas has a franchise tax on businesses, although from January 1, 2026, businesses with annual revenue at or below $2.65 million do not have to pay it.
Do states with no income tax ever tax crypto gains?
Washington is the main exception. It has no general income tax, but it charges a capital gains tax on the sale of long-term capital assets. The tax began at 7%, and the 2025 standard deduction was $278,000. The Department of Revenue says cryptocurrency counts as intangible property for this tax, so a Washington resident who sells crypto held for more than a year can owe it if gains exceed the deduction. Only individuals are subject to it.
Where you live when you sell matters, so moving states can change which rules apply. Separate state rules on licensing crypto businesses are covered in state crypto licenses.
Rules differ by country and change often. Check the tax authority or a qualified professional for your own situation.
