Brazil crypto tax rules treat gains on crypto as capital gains for individuals, with a monthly exemption for smaller sellers. The regime depends on where the crypto is held, in Brazil or abroad. As of October 2026, the rules in place before a 2025 reform attempt still apply.

How is crypto taxed in Brazil on domestic exchanges?

For crypto bought and sold through Brazilian platforms, gains are calculated month by month. If the total value of crypto you sell in a month is R$35,000 or less, the gain for that month is exempt. If sales go above that line, the gain is taxed at progressive capital gains rates that start at 15% and reach 22.5% for very large gains.

What is the Brazil crypto tax rate for assets held abroad?

Receita Federal treats virtual assets as located abroad when a foreign institution holds or trades them. Under Law 14,754 of 2023, gains on these foreign financial investments are taxed at a flat 15%, calculated once a year in the annual income tax return, and the R$35,000 monthly exemption does not apply. Holdings must be declared in the annual return when the cost of a given asset is R$5,000 or more on December 31, even if no tax is due.

What happened to the 17.5% crypto tax in Brazil?

On June 11, 2025 the government issued Provisional Measure 1303, which would have taxed crypto gains at a flat 17.5% and removed the monthly exemption. Provisional measures expire if Congress does not approve them. On October 8, 2025, the Chamber of Deputies voted to take it off the agenda, and it lapsed, so the earlier rules stayed in force.

A separate idea to charge IOF, a financial transactions tax, on stablecoin operations has also been discussed. As of September 2026 its public consultation had been pushed back, with 2027 named as the earliest date. For background on these assets, see what is a stablecoin.

How does Brazil crypto reporting to Receita Federal work?

Since 2019, Brazilian exchanges have reported user operations to Receita Federal. In November 2025 the agency issued Normative Instruction 2,291, creating DeCripto, a reporting system modeled on the OECD's Crypto-Asset Reporting Framework. Monthly DeCripto reports began in July 2026. Brazilian exchanges and foreign exchanges serving Brazilian customers must report, as must residents who use foreign platforms or whose operations top R$35,000 in a month.
