Crypto tax in Malaysia depends on whether a gain counts as income or as a capital gain. The Inland Revenue Board (LHDN) says profits from trading crypto as a business are taxable, while gains from simply holding and later selling an investment are generally not. As of October 2026, the key document is LHDN's second edition of its digital currency guidelines, published on December 5, 2025.

Is there a crypto capital gains tax in Malaysia?

Not for most individuals. Malaysia introduced a capital gains tax from January 1, 2024, but LHDN's guidelines say it is not currently imposed on capital-nature disposals of digital currency made in Malaysia. Gains on foreign assets matter mainly for companies, limited liability partnerships, trust bodies and co-operatives, and only when brought into Malaysia.

If a gain is capital in nature, the sale proceeds are not taxed, and related costs cannot be deducted either.

Is crypto trading taxed in Malaysia?

It can be. LHDN treats active traders as earning income, so their trading profits are taxable and their trading losses and expenses may be deductible. To decide which side of the line someone is on, LHDN uses the "badges of trade". These include how long the coins were held, how often the person trades, the motive for buying, how the purchase was financed and the circumstances of the sale. No single factor decides the result. Frequent buying and selling, short holding periods and borrowed money point toward trading. Swapping one coin for another follows the same capital or revenue test.

What is the crypto income tax rate in Malaysia?

There is no special crypto rate. Taxable crypto income is added to a person's other income and taxed at normal rates. For resident individuals, LHDN's table for the 2023 to 2025 years of assessment runs from 0% on the first RM5,000 of chargeable income up to 30% on income above RM2 million.

How are bitcoin mining, payments and salaries taxed?

LHDN says miners are taxed under existing law, and mining expenses and losses may be deductible. Whether selling mined coins is taxable again depends on the badges of trade, and fees earned from mining for clients may be taxable.

Businesses that accept crypto for goods or services record it as income at its open market value in ringgit. A salary paid in crypto is taxable for the employee. Tokens received free through airdrops or forks are not treated as income on receipt, unless given in return for goods or services. LHDN expects records such as transaction dates, exchange statements, wallet addresses, receipts and bank statements.

Where a person trades also matters for the legal side. Malaysia's Securities Commission keeps a public list of registered exchanges, covered in is crypto legal in Malaysia.
