What is the Crypto ATM Fraud Prevention Act?
The Crypto ATM Fraud Prevention Act is a US Senate bill that would add scam warnings, daily limits and refunds at crypto ATMs. It has not become law.
The Crypto ATM Fraud Prevention Act is a proposed US federal law that would set nationwide anti-fraud rules for crypto ATMs, also called crypto kiosks. Senator Dick Durbin of Illinois introduced it as S. 710 in February 2025 with Senators Blumenthal, Reed and Welch. As of October 2026 it is still a bill, not law. How the scams themselves work is covered in how crypto ATM scams work.
What would the Crypto ATM Fraud Prevention Act of 2025 require?
The bill text on Congress.gov sets duties for kiosk operators:
- Location reporting. Operators would send the Treasury a list of every kiosk address at least every 90 days.
- Scam warnings. Before each transaction, the screen would warn that transfers are final and describe common scams, such as impersonation, threats and fake job offers. Customers would have to acknowledge the warning.
- Receipts. Each receipt would show fees, the dollar amount and transaction details. Durbin said this helps police trace funds.
- Blockchain screening. Operators would use blockchain analytics to block transfers to wallets known to be linked to fraud.
- Compliance staff. Each operator would need an anti-fraud policy, a compliance officer and live customer service.
Violations would carry penalties of $10,000 each.
What daily limits and refunds would the bill set?
The protections focus on new customers, meaning anyone within 14 days of their first transaction with an operator.
- Limits. No more than $2,000 in any 24 hours and $10,000 in total.
- Live check. Transactions of $500 or more would need a live phone or video call confirming the customer is not being scammed.
- Refunds. A new customer who was tricked could claim a full refund, including fees, within 30 days, with a police report and sworn statement. Existing customers could get their fees back.
The bill neither bans crypto ATMs nor caps fees, and states may add stronger protections. The machines themselves are explained in how bitcoin ATMs work.
Has the Crypto ATM Fraud Prevention Act passed?
No. Congressional records show S. 710 was read twice and referred to the Senate Committee on Banking, Housing, and Urban Affairs on the day it was introduced, with no further action listed. In March 2026 Durbin filed an amendment with similar crypto ATM provisions to a housing bill, but his release reported no vote. In May 2026 he was still promoting the bill with AARP Illinois. Senator Cynthia Lummis has said kiosk fraud could be addressed in market structure legislation.
Which states have crypto ATM laws?
States have moved faster. The ABA Banking Journal reported in April 2026 that 20 states had adopted restrictions, and that Indiana banned kiosks outright in March 2026. South Dakota limits users to $1,000 a day and $10,000 a month and requires full refunds for fraud. California has limited kiosks to $1,000 per customer per day since 2024, and since 2025 has capped charges at the greater of $5 or 15% of the transaction.
Rules differ by state and change often. Check your state regulator or a qualified professional for your own situation.
