Yes, crypto is legal in Spain. People can buy, hold, trade and sell bitcoin and other crypto, and the rules focus on the companies that provide crypto services. As of October 2026, those companies need authorisation under the EU's Markets in Crypto-Assets regulation (MiCA).

Is bitcoin legal in Spain?

Yes. Crypto is not legal tender in Spain, where the euro has been the sole currency since 2002, and Spanish law treats crypto as intangible property. Before MiCA, Spain had no single crypto statute. Its main rule for businesses was a registration with the Bank of Spain under the anti-money laundering law, which the Bank of Spain says never meant it approved or supervised those firms' risks.

Since December 30, 2024, MiCA has applied directly in Spain. Tokens that count as financial instruments, such as security tokens, fall under the Securities Markets law (Ley 6/2023) instead. Our guide to MiCA covers the EU framework.

Is crypto banned in Spain?

No. A law guide on Spanish crypto rules notes there is no per se prohibition. Restrictions apply only to activities carried out without the required authorisation.

The CNMV handles authorisation and supervision of crypto-asset service providers. The Bank of Spain keeps powers over issuers of stablecoins such as e-money tokens. The CNMV also issued its own crypto advertising rules in 2022, later replaced by Circular 1/2024 once MiCA applied.

Is crypto trading legal in Spain?

Yes. Individuals can trade freely, but the provider matters. Spain gave existing firms the maximum 18-month transition, and the Bank of Spain closed its old register on July 1, 2026. From that date, providers without MiCA authorisation must wind down. A legal commentary in El Derecho advised investors to check whether their provider is authorised, and named Spanish entities such as BBVA, CaixaBank, Renta 4 Banco and Bit2Me among those on the MiCA list. Many authorised providers serve Spain from other EU states.

Trading gains, and even swaps between coins, can create tax obligations, covered in how crypto is taxed in Spain.
