Yes, crypto is legal in Malta. Individuals can buy, hold and sell bitcoin, and Malta was one of the first EU countries to write dedicated rules for crypto businesses. As of October 2026, those firms need a licence under the EU's MiCA regulation, granted in Malta by the Malta Financial Services Authority (MFSA).

Is bitcoin legal in Malta?

Yes. Maltese law regulates the companies that provide crypto services, not people who own coins. The MFSA and Malta's anti-money laundering unit, the FIAU, supervise those firms. Tax depends on what you do with crypto, as explained in how crypto is taxed in Malta.

What are Malta's crypto laws?

Malta introduced its Virtual Financial Assets (VFA) framework in 2018, which the MFSA describes as similar to MiCA. The VFA Act, Chapter 590, has since been adapted for MiCA, and the MFSA's June 2026 letter to firms refers to it as the Markets in Crypto-Assets Act.

Malta used the full 18-month MiCA transition, according to ESMA's list. The MFSA wrote to firms on June 25, 2026 that the transitional measures, set out in Article 66 of Chapter 590, would expire on June 30, 2026. Firms with clients had to hold a MiCA licence by then. Those that could not were told to stop onboarding and marketing, limit services to closing or transferring positions, and give clients a deadline before residual positions were closed. From July 1, clients of unlicensed firms lost MiCA protections for their assets.

How does Malta cryptocurrency regulation compare with other EU countries?

Malta licensed early, which drew scrutiny. In a peer review published on July 10, 2025, ESMA found the MFSA only partially met expectations when it authorised one particular crypto firm, Cointelegraph reported. Harneys summarised ESMA's view that the assessment should have been more thorough on the firm's business plan, conflicts of interest, governance, IT and custody risks and some anti-money laundering points. ESMA also found the MFSA had built good expertise and resources. The MFSA said it was largely meeting expectations and was taking on the recommendations.

Is Malta crypto friendly?

Malta has attracted major exchanges. As of July 2025, MiCA firms on the MFSA register included Bitpanda, Crypto.com and OKX, Cointelegraph noted, with OKX licensed in January 2025. Finextra reported that Gemini moved its European base to Malta, citing the regulatory climate. Licensed firms can serve clients across the EU through MiCA's passport.
