Is crypto legal in Denmark?
Crypto is legal in Denmark. The EU's MiCA rules apply, Finanstilsynet authorises crypto firms, and trading and mining are allowed but taxed.
Crypto is legal in Denmark as of October 2026. Danes can buy, hold, trade and mine crypto, and the companies that serve them are regulated under the EU's Markets in Crypto-Assets regulation (MiCA). Crypto is not money in Denmark, though. The Danish krone remains the currency, and the central bank has long warned about the risks.
Is bitcoin legal in Denmark?
Yes. MiCA, EU Regulation 2023/1114, applies directly in Denmark, and its rules for crypto service providers have applied since December 30, 2024. Denmark added national provisions to its Financial Business Act with Act No. 481 of May 22, 2024, according to Lovguiden. Finanstilsynet, the Danish Financial Supervisory Authority, grants and withdraws authorisations and supervises the sector. For the EU background, see what is MiCA.
Danmarks Nationalbank does not see bitcoin as money. In a widely reported statement from around 2014, it said bitcoin had no issuer standing behind it and compared it to glass beads, warning that prices could swing sharply and that users had no deposit guarantee, CoinDesk reported.
Is crypto trading legal in Denmark?
Trading is legal. Gains are taxable. Skattestyrelsen, the Danish Tax Agency, treats most private crypto trading as speculation, so gains are taxed much like salary and losses get a smaller deduction. Our guide to how crypto is taxed in Denmark covers the details.
Since 2026, crypto service providers must also report user data to the tax authorities under the EU's DAC8 rules, starting with 2026 transactions, Lovguiden notes. See what is DAC8.
Is crypto mining legal in Denmark?
Yes. Mining is allowed, and the tax system treats it as an activity that produces taxable income. Danish tax rulings have dealt with mining directly. Lovguiden lists a 2019 Skatterådet binding answer finding that bitcoin mined in 2011 to 2013 was a hobby business, and a 2021 answer on a data storage and mining business. Whether mining counts as a hobby or a business affects how income and costs are treated.
Can I buy bitcoin in Denmark?
Yes, through a crypto firm authorised under MiCA. Anyone who wants to provide crypto-asset services must apply to Finanstilsynet, while banks, investment firms and similar already-licensed firms can file a notification instead, according to the authority's application page on Virk.dk.
Denmark gave existing providers the longest transition MiCA allowed, 18 months, ESMA's list shows. That window ended on July 1, 2026. The law firm Schjødt said in June 2026 that four Danish firms had been authorised, among them Lunar Bank, and that firms without a licence must wind down Danish operations. Several other applications were rejected.
Rules differ by country and change often. Check the regulator or a qualified professional for your own situation.
