Is crypto legal in Sweden?
Crypto is legal in Sweden. MiCA applies, Finansinspektionen authorises crypto firms, and mining is allowed but lost its electricity tax break in 2023.
Crypto is legal in Sweden as of October 2026. Swedes can buy, hold, trade and mine crypto. The firms that serve them are regulated under the EU's Markets in Crypto-Assets regulation (MiCA), supervised by Finansinspektionen (FI). Mining is not banned, but Sweden removed a tax break that once made it cheap.
Is bitcoin legal in Sweden?
Yes. Owning and trading bitcoin is legal, and gains are taxed as capital income, as our guide to how crypto is taxed in Sweden explains.
Under MiCA, the main rule is that FI authorisation is required to provide crypto-asset services, FI says. Banks, investment firms, e-money institutions and some fund managers can notify FI instead of applying. FI aims to decide on a complete application within 40 working days, with a possible 20-day extension. For the EU framework, see what is MiCA.
Is crypto trading legal in Sweden?
Yes, through authorised providers. Sweden chose a 9-month transitional period for firms already operating, ESMA's list shows. The law firm Schjødt explains that under Sweden's MiCA implementation act, firms active before December 30, 2024 could continue until September 30, 2025. Those that applied by October 1, 2025 may keep operating in Sweden until FI's decision, including any appeal, is final.
Licences have started to arrive. In October 2025 the exchange Safello said it had received MiCA authorisation from FI, covering custody, transfers, order handling and exchanging crypto for money and for other crypto, Bitcoin.com News reported. Safello described itself as the first Swedish company to receive such a licence.
Is crypto mining legal in Sweden?
Yes, but it has become much more expensive. Sweden used to let data centres pay a sharply reduced energy tax on electricity. In September 2022 the Ministry of Finance proposed abolishing that reduction from July 1, 2023, PwC Sweden reported. Crypto.news reported in April 2023 that the change would raise the tax from SEK 0.006 to SEK 0.36 per kilowatt-hour, an increase of about 6,000%.
The tax agency has also targeted miners who claimed the old break without being eligible. In April 2024, DatacenterDynamics reported that Skatteverket had acted against 18 data centres that concealed crypto mining while claiming tax incentives, and said it was owed about 990 million kronor including VAT and surcharges. Courts upheld most of the decisions that were appealed.
Mining income is taxable, as the Sweden tax guide explains. For background, see how is crypto mining taxed and is crypto mining legal.
