Crypto is legal in the Bahamas as of October 2026, under a dedicated licensing law. Individuals can own and trade crypto, while businesses that offer crypto services must be registered with the Securities Commission of The Bahamas (SCB). Bitcoin is an asset there, not money.

Is bitcoin legal in the Bahamas?

Yes. There is no ban on owning or trading bitcoin. What the law controls is who may offer crypto services. Under DARE 2024, carrying on a digital asset business in or from the Bahamas requires SCB registration, and serving Bahamian residents from abroad also requires a licence unless the client is an accredited investor, according to the Chambers Fintech 2026 guide.

Legal tender is a separate matter. Only the Central Bank of The Bahamas may issue it. The central bank also runs the Sand Dollar, a central bank digital currency that moves Bahamian dollars digitally. Digital currencies and e-money fall under the central bank's regime, not DARE 2024.

How does Bahamas crypto regulation work?

DARE 2024 replaced the DARE Act 2020 and widened the activities it covers. According to the SCB's announcement and the Chambers guide, it:

  • Covers exchanges, custody and custodial wallets, staking, advisory and management services, and crypto derivatives.
  • Sets reserve, segregation, reporting and redemption rules for stablecoins, and bans algorithmic stablecoins.
  • Introduces a disclosure regime for staking client assets.
  • Prohibits issuing privacy tokens.
  • Bars mining as a business, except where it is ancillary to a registered firm or done as proprietary mining.

Existing registrants had 90 days to apply under the new law. The SCB said the framework reflects IOSCO standards and FATF recommendations.

Is the Bahamas crypto friendly?

The Bahamas welcomes crypto firms that accept close supervision. The SCB runs a fintech hub, SCB FinTLink, launched in October 2019, and some traditional financial firms have added crypto exchange and custody arms, the Chambers guide notes. A September 2026 Gleaner commentary put the number of authorized virtual asset providers at 19.

The country's reputation was tested by FTX. After FTX Trading and its affiliates filed for US bankruptcy, the SCB froze the assets of FTX Digital Markets and obtained a court-appointed liquidator, and that liquidation is ongoing.
