Yes, crypto is legal in Belgium. People can buy, hold, trade and sell bitcoin and other crypto, and companies that provide crypto services must be authorised under the EU's Markets in Crypto-Assets regulation (MiCA). Since July 1, 2026, providers without that authorisation must stop offering services.

Is bitcoin legal in Belgium?

Yes. There is no ban on owning or using bitcoin. Belgium implemented MiCA through the Law of December 11, 2025, which divides crypto oversight between two bodies. The Financial Services and Markets Authority (FSMA) authorises crypto-asset service providers, supervises their conduct and oversees crypto offerings and market abuse rules. The National Bank of Belgium handles prudential oversight of certain firms it already supervises, such as payment and e-money institutions. Our guide to MiCA covers the EU rules.

Is crypto allowed in Belgium?

Yes, but providers need a licence. Belgium had a national registration regime for crypto firms under a Royal Decree of February 8, 2022. The FSMA says it never granted any registrations under it, because no applicant filed a complete application before those rules expired.

That shaped Belgium's MiCA transition. Providers from other EU states could continue serving Belgium until July 1, 2026 only if they were already active there on December 30, 2024 and authorised at home. In a June 25, 2026 release, the FSMA said no crypto firm yet held an FSMA authorisation. That means crypto services in Belgium come from providers authorised in another EU country that have passported their services in.

Is crypto trading legal in Belgium?

Yes. Individuals can trade through authorised providers. The FSMA keeps a list of fraudulent platforms, and in July 2026 it added six firms it said were offering crypto services in Belgium without authorisation or a home country notification, Cointelegraph reported. It urged consumers to check the official register of crypto providers and noted that crypto is not covered by a compensation scheme. For warning signs, see how to spot a fake crypto exchange.

Since 2026, gains are covered by a new capital gains tax, explained in how crypto is taxed in Belgium.

Does Belgium use bitcoin?

Not as money. Belgium's legal tender is the euro, which replaced the Belgian franc in 2002 across the euro area. Shops and individuals may accept bitcoin by private agreement, but no one is obliged to.

Rules differ by country and change often. Check the regulator or a qualified professional for your own situation.
