Is bitcoin legal in New Zealand?
Yes. Owning and using bitcoin is legal, but it is not legal tender. The Reserve Bank of New Zealand says legal tender means its own banknotes and coins. Businesses can accept any other form of payment they choose, so a shop may take bitcoin if it wants to, but no one is required to.
What are New Zealand's crypto laws?
There is no crypto-specific licensing law. Instead, the Financial Markets Authority (FMA) explains how general rules apply:
- An exchange that lets customers trade crypto provides a financial service, such as operating a value transfer service, and must register on the Financial Service Providers Register if the registration law applies. Providers serving retail clients must join a dispute resolution scheme.
- Crypto businesses are likely to be "financial institutions" under the anti-money laundering law. The DIA became the sole AML/CFT supervisor for all reporting entities on July 1, 2026.
- Some tokens count as financial products, such as debt, equity, managed investment or derivative products. Offering those to retail investors can require a licence and a disclosure statement.
- Fair dealing rules ban misleading claims in white papers, websites and promotions.
Crypto ATMs have been a focus. In July 2025, the government said it would ban them over money laundering concerns, 1News reported. Ministers later rejected a blanket ban and chose powers to cap crypto ATM transactions or ban cash payments for high-risk assets if harm is shown, OpenGov Asia reported. Those powers are part of an anti-money laundering amendment bill and were not yet law when announced. See how Bitcoin ATMs work for background.
Is crypto mining legal in New Zealand?
Yes, mining is legal. Inland Revenue treats it as an ordinary taxable activity: in most cases, crypto received from mining, such as block rewards and transaction fees, is taxable, whether mining is run as a business or a profit-making scheme. The mining service itself is zero-rated for GST because it is supplied to a ledger outside New Zealand. Selling crypto bought mainly to resell is also taxed, as covered in how crypto is taxed in New Zealand. For other countries, see is crypto mining legal.
Rules differ by country and change often. Check the regulator or a qualified professional for your own situation.
