Is crypto mining legal in Canada?
Crypto mining is legal in Canada, but BC permanently bars new mining hookups to BC Hydro and Quebec limits power for new miners. Mining is business income.
Crypto mining in Canada is legal, and no federal law bans it. The real limits come from provincial electricity policy, and British Columbia and Quebec have both moved to limit how much power new miners can get. Trading platform rules are a separate matter, covered in how crypto is regulated in Canada.
Is there a BC crypto mining ban?
Yes, for new projects. The BC government suspended new cryptocurrency mining connections to BC Hydro's grid in December 2022. Amendments to the Utilities Commission Act in spring 2024 gave cabinet power to regulate electricity service for mining, and the Cryptocurrency Power Regulation extended the pause from 18 to 36 months.
In fall 2025, the province made it permanent. Under the regulation, BC Hydro is permanently relieved of its obligation to serve certain new crypto mining operations. When the change was introduced in October 2025, Energy Minister Adrian Dix said power would be prioritised for job-producing sectors. The government page, last updated February 12, 2026, describes limits on new connections and does not address existing mines.
What is Quebec's crypto mining moratorium?
Quebec first halted approvals of new mining projects while it wrote new rules, CoinDesk reported, after Hydro-Québec warned it could not meet every request. The province then set aside a limited block of power for crypto use. In November 2022, Hydro-Québec asked the energy regulator to reallocate the 270 MW reserved for crypto mining, and the Régie de l'énergie approved suspending the allocation process on January 10, 2023. Existing miners were not cut off.
As of October 2026, Hydro-Québec's terms for new projects of 50 kW or more include:
- a rate of 18.078 cents per kWh on all energy used
- non-firm service that can be curtailed for up to 300 hours a year
- the customer paying the full cost of connection work
- ministerial approval for projects of 5 MW or more, required since February 15, 2023
How is crypto mining taxed in Canada?
The Canada Revenue Agency says that in most cases mining counts as carrying on a business because of its scale and resources. Mining income, including newly created coins and transaction fees, is business income when earned. ASIC miners and GPU rigs may qualify for capital cost allowance in class 50, assessed item by item.
