Is crypto mining legal in India?

Crypto mining in India is not banned, and no law licenses it. Mined coins fall under the 30% VDA tax, and mining hardware costs cannot be deducted.

Crypto mining in India is legal in the sense that nothing prohibits it. No central law bans mining, and no regulator issues mining licences. Crypto is legal to hold but is not legal tender, and the rules that do exist focus on exchanges and on tax rather than on the act of mining itself.

Is bitcoin mining legal in India?

Yes, as far as current law goes. India treats crypto as a "virtual digital asset" (VDA), a term added to income tax law by the Finance Act 2022. VDAs are taxable but not legal tender. The wider regulatory picture is covered in how crypto is regulated in India.

There is no separate mining permit. We found no central government rule, as of October 2026, that bans mining or sets a special electricity tariff for it. Miners still pay for power under their normal electricity connection and must follow general laws on electricity use.

Do crypto miners need FIU registration in India?

Not for mining alone. A Finance Ministry notification dated March 7, 2023 brought five VDA activities under the Prevention of Money Laundering Act. They are exchanging VDAs for money and back, swapping one VDA for another, transferring VDAs, holding or managing VDAs for others, and financial services linked to a token sale.

Businesses doing those things must register with the Financial Intelligence Unit (FIU-IND) and run customer checks. Mining coins for yourself is not on that list. A miner who later sells coins through a platform will still go through that platform's KYC, and a mining business that also offers custody or exchange services could fall inside the rules.

How is crypto mining taxed in India?

India has no mining-specific tax rule, but the general VDA regime applies when mined coins are sold or transferred. Income from transferring a VDA is taxed at a flat 30% plus cess and any surcharge, and the Income Tax Department says the only deduction allowed is the cost of acquisition. Losses cannot be set off against other income.

For miners, that matters a lot. In a 2022 written reply to the Lok Sabha, the Minister of State for Finance said infrastructure costs incurred in mining will not count as cost of acquisition, because they are capital expenditure. In practice, electricity and hardware spending does not reduce the 30% tax on a sale. The full VDA rules, including tax deducted at source on transfers, are explained in how crypto is taxed in India.

How a mining reward is taxed at the moment it is received is less settled, and advisers differ. For the general approach other countries take, see how crypto mining is taxed, and for the mechanics see how bitcoin mining works.

Rules differ by country and change often. Check the tax authority or a qualified professional for your own situation.
